1. Acceptance of Terms

By registering an account, accessing, or using any services provided by 38ph, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy and Responsible Gaming policies. These Terms apply to all users of the 38ph platform, including but not limited to visitors, registered users, and VIP members.

If you do not agree with any part of these Terms, you must immediately discontinue use of the 38ph platform. Continued use of our services constitutes acceptance of any modifications or updates to these Terms, which we reserve the right to make at any time without prior notice.

38ph is operated under license from the Philippine Amusement and Gaming Corporation (PAGCOR) and complies with all applicable laws and regulations governing online gaming in the Republic of the Philippines. Our services are intended solely for use by residents of the Philippines who meet the legal age requirement.

2. Eligibility Requirements

2.1 Age Verification

All users must provide valid identification documents for age verification purposes. Acceptable forms of identification include Philippine passport, driver's license, UMID, SSS ID, or any government-issued ID showing your date of birth. 38ph reserves the right to request additional documentation at any time to verify your age and identity.

2.2 Geographic Restrictions

Our services are available exclusively to residents of the Philippines. By using 38ph, you represent and warrant that you are physically located within the Philippines at the time of access. We employ IP tracking and geolocation technology to verify your location. Attempts to circumvent geographic restrictions through VPN, proxy servers, or similar technologies are strictly prohibited and will result in immediate account suspension.

2.3 Legal Capacity

You must have the legal capacity to enter into binding contracts under Philippine law. You represent that you are not prohibited by law from gambling and that your use of 38ph services is not illegal in your jurisdiction within the Philippines.

2.4 Single Account Policy

Each individual is permitted only one (1) account on the 38ph platform. Multiple accounts, duplicate accounts, or accounts registered under false identities are strictly prohibited. If we detect multiple accounts linked to the same individual, we reserve the right to suspend or terminate all associated accounts and forfeit any balances therein.

3. Account Registration and Security

3.1 Registration Process

To use 38ph services, you must complete the registration process by providing accurate, current, and complete information including your full legal name, date of birth, valid Philippine mobile number, email address, and physical address. All information provided must match your government-issued identification documents.

3.2 Account Credentials

Upon registration, you will create a username and password. You are solely responsible for maintaining the confidentiality of your account credentials. You must not share your username, password, or account access with any third party. Any activity conducted through your account will be deemed to have been authorized by you.

3.3 Account Security Obligations

You agree to immediately notify 38ph of any unauthorized use of your account or any other security breach. We recommend enabling two-factor authentication (2FA) for enhanced account security. While 38ph implements industry-standard security measures, you acknowledge that you bear responsibility for any losses resulting from unauthorized access to your account if such access was facilitated by your failure to maintain account security.

3.4 Information Updates

You must promptly update your account information if any details change. Failure to maintain accurate information may result in delays in withdrawals, account verification issues, or account suspension. 38ph is not liable for any consequences arising from outdated or inaccurate account information.

4. Deposits and Payment Methods

4.1 Accepted Payment Methods

38ph accepts deposits via GCash, PayMaya, bank transfers (BPI, BDO, Metrobank, UnionBank, and other major Philippine banks), and other payment methods as indicated on our platform. All deposits must be made in Philippine Peso (PHP). The minimum deposit amount is one hundred pesos (₱100).

4.2 Deposit Processing

Deposits made through GCash, PayMaya, and instant bank transfers are typically credited to your 38ph account within seconds to minutes. Traditional bank transfers may take one (1) to three (3) business days to process. 38ph is not responsible for delays caused by third-party payment processors or banking institutions.

4.3 Source of Funds

All deposits must come from payment accounts registered in your own name. Third-party deposits are strictly prohibited. You represent and warrant that all funds deposited into your 38ph account are derived from legitimate sources and are not the proceeds of illegal activity. 38ph reserves the right to request documentation verifying the source of your funds as part of our anti-money laundering (AML) compliance obligations.

4.4 Deposit Limits

38ph may impose daily, weekly, or monthly deposit limits for responsible gaming purposes. You may set your own deposit limits through your account settings. Once set, deposit limits can only be increased after a cooling-off period of twenty-four (24) hours. Decreases to deposit limits take effect immediately.

4.5 Deposit Fees

38ph does not charge fees for deposits. However, your payment provider (GCash, PayMaya, or your bank) may apply their own transaction fees. You are responsible for any fees charged by third-party payment processors.

5. Withdrawals and Payouts

5.1 Withdrawal Methods

Withdrawals can be processed to the same payment method used for deposits. For security purposes, 38ph requires that withdrawals be made to payment accounts registered in your name that match your verified 38ph account information. The minimum withdrawal amount is five hundred pesos (₱500).

5.2 Withdrawal Processing Times

Withdrawal requests are typically processed within six (6) to twenty-four (24) hours. First-time withdrawals or withdrawals exceeding certain thresholds may require additional verification and may take up to seventy-two (72) hours to process. Once approved by 38ph, the time for funds to reach your account depends on your payment provider.

5.3 Verification Requirements

Before your first withdrawal, you must complete account verification by submitting valid government-issued identification, proof of address, and proof of payment method ownership. 38ph reserves the right to request additional documentation at any time. Withdrawals will not be processed until verification is complete.

5.4 Withdrawal Limits

Standard withdrawal limits are twenty thousand pesos (₱20,000) per transaction and one hundred thousand pesos (₱100,000) per week. VIP members may be eligible for higher withdrawal limits. 38ph reserves the right to adjust withdrawal limits based on account history, verification level, and gaming activity.

5.5 Wagering Requirements

All deposits must be wagered at least one (1) time before withdrawal is permitted. Bonus funds are subject to specific wagering requirements as outlined in the applicable bonus terms. Failure to meet wagering requirements may result in withdrawal rejection and forfeiture of bonus funds and associated winnings.

5.6 Anti-Money Laundering Compliance

As part of our AML obligations under Philippine law, 38ph monitors withdrawal patterns and reserves the right to refuse withdrawals or request additional documentation if suspicious activity is detected. Unusual withdrawal patterns, mismatched deposit/withdrawal methods, or other red flags may trigger enhanced due diligence procedures.

6. Gaming Rules and Conduct

6.1 Fair Play

All games on the 38ph platform are governed by specific rules accessible within each game. You agree to play fairly and in accordance with these rules. The use of bots, automated betting systems, collusion, chip dumping, or any other form of cheating or unfair advantage is strictly prohibited.

6.2 Game Integrity

All games use certified Random Number Generators (RNG) to ensure fair and random outcomes. Game results are final and cannot be altered once determined. 38ph reserves the right to void bets and withhold winnings if game integrity is compromised or if cheating is detected.

6.3 Betting Limits

Each game has minimum and maximum betting limits displayed within the game interface. 38ph reserves the right to modify betting limits at any time without prior notice. Bets placed in violation of betting limits may be voided.

6.4 Game Malfunctions

In the event of a game malfunction, system error, or technical issue, all affected bets will be voided, and stakes will be returned to player accounts. 38ph is not liable for losses resulting from technical malfunctions beyond our control. If a malfunction results in incorrect payouts, 38ph reserves the right to correct the error and adjust account balances accordingly.

6.5 Prohibited Activities

The following activities are strictly prohibited and may result in immediate account termination and forfeiture of funds:

• Using automated betting software, bots, or scripts
• Collusion with other players to gain unfair advantage
• Exploiting software bugs or system vulnerabilities
• Engaging in fraudulent activity or money laundering
• Abusing bonuses or promotional offers
• Creating multiple accounts to circumvent limits or restrictions
• Reverse engineering or attempting to manipulate game outcomes
• Harassing other players or 38ph staff

6.6 Bet Settlement

All bets are settled in accordance with official game results and our published betting rules. In cases of disputed outcomes, 38ph's decision is final and binding. Sports betting results are settled based on official league statistics and announcements.

7. Bonuses and Promotions

7.1 Bonus Terms

All bonuses and promotions are subject to specific terms and conditions which must be accepted before claiming. Bonuses are not withdrawable until wagering requirements are met. Wagering requirements, game restrictions, maximum bet limits, and expiration dates vary by promotion and are clearly stated in each bonus offer.

7.2 Bonus Abuse

38ph reserves the right to void bonuses and associated winnings if bonus abuse is detected. Bonus abuse includes but is not limited to: creating multiple accounts to claim bonuses multiple times, irregular betting patterns designed solely to clear wagering requirements, or any other activity contrary to the spirit of the promotion.

7.3 Promotion Modifications

38ph reserves the right to modify, suspend, or cancel any promotion at any time without prior notice. In the event of promotion cancellation, any wagering requirements associated with that promotion will be removed, but previously credited bonus funds may be forfeited.

8. Intellectual Property Rights

All content on the 38ph platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof (the "Content"), is the property of 38ph or its content suppliers and is protected by Philippine and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the 38ph platform for personal, non-commercial entertainment purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content without prior written consent from 38ph.

9. Limitation of Liability

To the fullest extent permitted by Philippine law, 38ph shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the services
• Any conduct or content of any third party on the services
• Unauthorized access, use, or alteration of your transmissions or content
• Statements or conduct of any third party on the services
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services

38ph's total liability to you for all claims arising from or related to the services shall not exceed the amount you paid to 38ph in the three (3) months immediately preceding the event giving rise to liability.

10. Account Suspension and Termination

10.1 Termination by User

You may close your account at any time by contacting customer support. Upon account closure, you must withdraw any remaining balance. Accounts with pending bonuses or wagering requirements may be subject to forfeiture of bonus funds upon voluntary closure.

10.2 Termination by 38ph

38ph reserves the right to suspend or terminate your account at any time, with or without notice, for any reason including but not limited to violation of these Terms, fraudulent activity, abusive behavior, or as required by law or regulatory authorities. Upon termination, any remaining account balance (excluding forfeited funds) will be returned to you after deducting any amounts owed to 38ph.

10.3 Self-Exclusion

As part of our commitment to responsible gaming, you may request self-exclusion from 38ph for a specified period. Self-exclusion requests can be made through customer support and will be processed within twenty-four (24) hours. During the self-exclusion period, you will be unable to access your account or create new accounts.

11. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from or relating to these Terms or your use of 38ph services shall be subject to the exclusive jurisdiction of the courts of Metro Manila, Philippines.

Before initiating any legal proceedings, you agree to first attempt to resolve disputes through good faith negotiation with 38ph customer support. If a resolution cannot be reached within thirty (30) days, either party may pursue legal remedies.

12. Amendments to Terms

38ph reserves the right to modify these Terms and Conditions at any time. Material changes will be communicated via email notification or prominent notice on the platform. Your continued use of 38ph services following notification of changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of our services and close your account.
